Intellectual Property Rights Policy at Lucky Global LLC

We have a strict zero-tolerance policy against the sale of counterfeit and/or infringing products on our website. We take these matters very seriously to ensure that we maintain a fair and lawful marketplace for our customers.

We continuously monitor our product listings to prevent intellectual property infringements. In the event that any product is found to violate Lucky Global LLC’s policies, we will promptly remove the listing.

However, due to the large volume of products we offer, there may be occasional instances where intellectual property violations go undetected. In these cases, we encourage intellectual property right holders or customers to cooperate with us. If you believe your intellectual property rights have been infringed upon, please notify us, and follow our complaint procedure below.

1. Eligible Complaints

We accept complaints related to intellectual property infringements in the following cases:

  • Trademark Infringement: Unauthorized use of an identical or similar trademark on goods that are identical to, or closely resemble, the goods for which the trademark is registered.
  • Patent Infringement: Unauthorized use of someone else’s granted Design Patent or Utility Patent.
  • Copyright Infringement: Unauthorized use of content, images, or products created by others, including books, CDs, software, or any copyrighted work.
  • Other Activities: Any violation of local Intellectual Property Laws.

2. Procedure for Filing a Complaint

If you believe your intellectual property rights have been infringed upon, please follow these steps to submit a complaint:

  • Send a Notice of Claiming Infringement via email to: doantu9990@gmail.com.
  • After receiving your notice, our team will conduct a prompt internal investigation. If your complaint is valid, we will take the necessary actions against the infringing product listing(s).

3. Actions We May Take Against Infringing Products

If a product is found to be infringing upon intellectual property rights, we will take the following actions:

  • Remove the Infringing Product(s): We will immediately remove the infringing product(s) from our website.
  • Take Down Listings: Any product listings identified as infringing intellectual property rights will be taken down, especially when required by judicial, enforcement, or administrative authorities.
  • Destroy Infringing Inventory: If the infringement is proven valid or upheld by the court, any infringing inventory in our possession will be destroyed.
  • Ban the Sale: We will ban the sale of infringing products, ensuring that they are no longer available for purchase on our site.

We will maintain records of all infringement cases for one (1) year from the date any penalties have been imposed.
